1. Acceptance of Terms

By accessing or using Cozy ("the App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the App.

2. Description of Service

Cozy is a macOS desktop customization app that provides:

• Curated desktop theme sets (wallpaper + matching folder icons)
• One-click theme application
• Custom folder icon functionality via Finder extension
• Multi-monitor wallpaper support

3. Purchase Terms

Cozy offers multiple ways to access themes. All purchases are processed through the Apple App Store and are subject to Apple's terms and conditions.

Free tier:

• One complete theme (Rainbow Felt) is included free
• Includes wallpaper, folder icons, Finder extension, and multi-monitor support

Individual themes ($7.99 - $13.99):

• One-time, non-consumable purchase per theme
• Yours forever. No recurring charges
• Can be restored on any Mac signed into your Apple ID

Weekly subscription ($4.99/week):

• Auto-renewable subscription providing access to all 15 themes
• New themes included as they are released
• Payment is charged to your Apple ID account weekly
• Cancel anytime through your Apple ID settings
• Access to premium themes ends when the subscription expires

Lifetime access ($199.99):

• One-time purchase for all current and future themes
• Yours forever. No recurring charges

4. License & Ownership

Your License: We grant you a limited, non-exclusive, non-transferable license to use Cozy and its themes for personal use on Mac devices signed into your Apple ID.

Our Content: All wallpapers, icons, designs, and app content are owned by Lively Light and protected by copyright laws. You may not:

• Redistribute, sell, or share theme files
• Use assets in commercial projects without written permission
• Reverse engineer or extract assets from the app
• Claim our designs as your own
• Remove or modify any copyright notices

5. Permitted Use

You may use Cozy themes for:

• Personal desktop customization on your Mac devices
• Sharing screenshots of your desktop (with themes visible) on social media
• Educational or personal creative projects

6. Prohibited Use

You may NOT:

• Extract theme files to sell or redistribute
• Share your purchased content with others outside your Apple ID
• Use themes in commercial client work without a commercial license
• Modify and redistribute our content
• Use the app to violate any laws
• Attempt to circumvent purchase verification

7. System Requirements

Cozy requires:

• macOS 14.0 or later
• Approximately 200MB of free storage
• Internet connection for initial purchase verification

8. Theme Content

To provide you with the best experience:

• All theme content (wallpapers and icons) is included in the app
• Once installed, themes can be applied completely offline
• We release new themes regularly
• Updates to existing themes are provided free of charge

9. Refund Policy

All Cozy purchases are processed through Apple's App Store:

• All refund requests must be submitted to Apple directly
• Refunds are subject to Apple's refund policy
• We recommend using the free theme to evaluate the app before purchasing

If you experience technical issues, please contact us at hi@cozyapp.app before requesting a refund. We're happy to help resolve any problems.

10. Updates & Changes

We may:

• Update the app with new features or bug fixes
• Release new themes
• Modify pricing for new content (existing purchases are not affected)
• Update minimum macOS version requirements

11. Disclaimer of Warranties

Cozy is provided "as is" without warranties of any kind. We do not guarantee:

• Uninterrupted or error-free operation
• Compatibility with all Mac configurations
• That themes will meet your specific aesthetic preferences
• Availability of the service at all times

12. Limitation of Liability

To the maximum extent permitted by law, Lively Light shall not be liable for:

• Any indirect, incidental, or consequential damages
• Loss of data or system issues
• Issues arising from third-party software or macOS updates
• Any amount exceeding the purchase price you have paid

13. User Responsibilities

You are responsible for:

• Maintaining backups of important files
• Ensuring your Mac meets system requirements
• Keeping your macOS and Cozy app updated
• Managing your purchases and subscriptions through Apple's App Store

14. Termination

We reserve the right to terminate or suspend access for violations of these terms. You may stop using the app at any time by deleting it from your Mac. Your purchased content remains accessible as long as you have the app installed.

15. Privacy

Your use of Cozy is also governed by our Privacy Policy. We do not collect personal data. Your privacy is protected by design.

16. Changes to Terms

We may update these terms from time to time. Continued use of the app after changes constitutes acceptance of the new terms. We'll update the "Last updated" date at the top of this page.
